1. Acceptance of Terms

Welcome to the website of Roc City Movers ("Roc City Movers," "Company," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of www.roccitymovers.com and any related pages, content, features, and services (collectively, the "Site").

By accessing or using the Site, requesting a quote, submitting a form, or otherwise using any part of the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use the Site.

You must be at least 18 years old, or the age of majority in your state of residence, to use the Site and to enter into a moving services agreement with us.

2. Description of Services

Roc City Movers provides residential and/or commercial moving, packing, loading, unloading, and related relocation services (the "Services") within New York State.

The Site is provided to give visitors information about our Services, allow prospective customers to request quotes and estimates, schedule moves, and communicate with our team. The Site itself does not constitute an offer to provide Services, and use of the Site does not, by itself, create a contract for moving services between you and Roc City Movers.

3. Quotes and Estimates

Any pricing, quotes, or estimates provided through the Site, by phone, by email, or by text message are preliminary and provided for informational purposes only, based on the information you provide to us.

Quotes are not binding and are subject to change based on an in-home or virtual survey, final inventory, distance, labor, materials, access conditions, and other factors identified before or on the day of your move.

Your actual moving services, final pricing, and the rights and obligations of both parties with respect to your move are governed exclusively by a separate, signed written moving agreement, work order, and/or bill of lading ("Moving Agreement") provided to you by Roc City Movers, not by these Terms.

In the event of any conflict between these Terms and your Moving Agreement, the Moving Agreement will control with respect to the Services themselves.

4. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• use the Site in any way that violates any applicable federal, state, or local law or regulation;
• submit false, inaccurate, or misleading information in any quote request, contact form, or other submission;
• attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;
• interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
• use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission;
• upload or transmit viruses, malware, or other harmful code;
• impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• use the Site to send unsolicited advertising, spam, or other unauthorized communications.

We reserve the right to suspend or terminate your access to the Site, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs, videos, page design, and the compilation and arrangement thereof (the "Content"), is owned by or licensed to Roc City Movers and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

"Roc City Movers" and associated logos are trademarks of Roc City Movers. You may view, print, and download portions of the Content solely for your own personal, non-commercial use, provided you do not remove or alter any copyright, trademark, or other proprietary notices.

Except as expressly permitted above, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our prior written consent.

6. User Submissions

If you submit information through a quote request, contact form, review, testimonial, or similar feature on the Site ("Submissions"), you represent that the Submission is accurate and that you have the right to submit it.

You grant Roc City Movers a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display Submissions (such as testimonials) in connection with operating and promoting our business, unless you tell us otherwise in writing.

7. SMS/Text Messaging Communication (Roc City Movers SMS Updates)

Program Description:

Roc City Movers uses SMS to send customers important operational updates, moving quotes, appointment reminders, and service notifications related to their move.

You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at hello@roccitymovers.com or (585) 201-8231.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages at a frequency that varies based on your requested services. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

8. Third-Party Links and Services

The Site may contain links to third-party websites, applications, or services (for example, payment processors, review platforms, or social media) that are not owned or controlled by Roc City Movers.

We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of any third-party website or service is governed by that third party's own terms and privacy policy, and you access such links at your own risk.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS ON THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY QUOTE, ESTIMATE, OR INFORMATION PROVIDED THROUGH THE SITE WILL BE ACCURATE OR COMPLETE. ANY ACTUAL MOVING SERVICES ARE SUBJECT TO THE WARRANTIES, IF ANY, SET FORTH IN YOUR SIGNED MOVING AGREEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ROC CITY MOVERS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS SECTION DOES NOT APPLY TO OR LIMIT LIABILITY, RELEASE VALUATION, OR CARGO CLAIMS RELATED TO YOUR ACTUAL MOVE, WHICH ARE GOVERNED SOLELY BY YOUR SIGNED MOVING AGREEMENT AND APPLICABLE LAW.

Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Roc City Movers and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law; Dispute Resolution

These Terms and any dispute arising out of or related to the Site or these Terms will be governed by the laws of the State of New York, without regard to its conflict of laws principles.

You agree that any legal action or proceeding relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Monroe County, New York, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top of this page indicates when these Terms were last revised.

Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Severability; Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any Moving Agreement you sign with us, constitute the entire agreement between you and Roc City Movers regarding the Site.
